Terri Schiavo: The Next Moves (and Daddy Jeb)

In a very short span of time, Terri Schiavo's parents seem to have run through their options. Again. But boy howdy did lots of politicians get lots of press out of it! Let's recap the activity of the past day.

After the President and Congress pissed all over the separation of powers in order to sign into law a completely intrusive and unconstitutional bill, the Schiavo case went to federal court. An Alternet article by Lindsay Beyerstein of Majikthise succinctly explains the problems with this legislation. At any rate, the federal judge who caught the case promptly ruled that Terri's parents had no substantive arguments that would hold up in trial, and that Terri's rights were not being infringed upon. Just like the Florida courts have ruled all along. Terri's parents, predictably, appealed. The appeal was denied. From Yahoo News:

In a 10-2 decision, the 11th U.S. Circuit Court of Appeals refused Bob and Mary Schindler's request for an "expedited rehearing" by the full court. A three-judge panel from the same court ruled against the family earlier Wednesday.

So, that seems to be the end of the federal court option. What other political maneuvering is going on? From ABC News:

The Schindlers have vowed to take their fight to the U.S. Supreme Court, which refused to get involved previously.

We have to imagine that nothing has changed since the last time the SCOTUS declined to hear the case, and that this will soon hit a brick wall. How about the President? He left vacation early to sign the bill, surely he's still willing to jump in! From ABC News:

President Bush suggested Wednesday that he and Congress had done their best to help Terri Schiavo's parents prolong her life, and the White House said it has no further legal options.

Legal options? Hell, the options that the President and Congress have already employed weren't legal options, why start considering legality now? Anyway, it seems that the public sentiment that frowned on the government stepping in has indeed caught up with Bush and his cronies, and they are backing off. But, they've been sure to say (loudly enough for the pro-lifers and religious fundies to hear), they did their best, and they wish the outcome could have been different. Awww...

So, since that whole federal thing didn't do much good, how about going back to the Florida well? From ABC News:

The Florida Senate rejected a bill Wednesday to keep Terri Schiavo alive, turning back an attempt to resolve the contentious end-of-life debate with a state law, as legislators did in 2003.

The bill would have prohibited patients like Schiavo from being denied food and water if they didn't express their wishes in writing. The 21-18 vote came five days after her feeding tube was removed under court order.

And, in fact, that legislation died. Just when it looked like we were fresh out of nutjob tactics, though, another one came out of left field. From Yahoo News:

Jeb Bush and the state's social services agency filed a petition in state court to take custody of Schiavo and, presumably, reconnect her feeding tube. It cites new allegations of neglect and challenges Schiavo's diagnosis as being in a persistent vegetative state. The request is based on the opinion of a neurologist working for the state who observed Schiavo at her bedside but did not conduct an examination of her.

Sweet evil Jesus, will this shit ever stop? Does anyone really think that the same Florida courts that have been siding with Michael Schiavo for years, and who watched as George Bush swooped in and took the case away, will allow Jeb Bush and the state to take custody of Terri?

Hey Jeb — learn from your brother, and quit while you're not too far behind. You put on a nice show for the fundies, you let Terri's parents be strung along through a new round of legal hoopla, and you got lots of press. Now just sit down and shut the Hell up!

Terri is all but dead already. Let. Her. Die.

[Update 03-24: The Supreme Court has, for what appears to be the fifth time, declined to hear the Terri Schiavo case. Also, it appears that the Florida Courts have denied Jeb Bush's motion for the state to take custody of Terri. So, state judicial and legislative actions are now closed out, the actions in federal court appear to have run their course, the Congress and the President have bowed out, and the Schindlers (Terri's parents) now seem to be out of options once again. Maybe now, we can just let Terri die.]
